Department of Justice recognized for support of employees who serve in the National Guard

Wilmington – New Castle County Chief Prosecutor Josette Manning has been honored with a Patriot
Award from the Delaware Employer Support of the Guard and Reserve (ESGR) agency of the United
States Department of Defense. ESGR volunteer Judy Zaal presented Manning with the award last
week in recognition of extraordinary support of employees who serve in the National Guard and
Reserve.

“Josette’s receipt of this award is a fitting recognition of her strong support for her staff, both
when they are home and when they are away serving our nation,” Attorney General Beau Biden said.
“Because of the dedication of supervisors like Josette, members of the Guard and Reserve who work at
the Delaware Department of Justice are able to meet the unique challenges of the citizen soldier.”
Recipients of the Patriot Award are nominated by employees of the Guard and Reserve and
Manning was nominated by Deputy Attorney General Robert Surles, who also serves in the Delaware
Army National Guard. His nomination stated that Josette and fellow Department of Justice employees
are highly supportive of service in the armed forces and that the employer goes above and beyond
requirements to continue salary and benefits during mobilizations, notably keeping in touch with the
family of service members. During the award presentation, Surles spoke eloquently of the support,
cooperation and integrity displayed by Manning and fellow employees toward his own military service
and previous deployments. Manning accepted the award on behalf of the entire staff for their
collective support of the Department’s military employees.

According to Christine Kubik, Delaware ESGR Executive Director, “the Patriot Award was
created to publicly recognize individuals who provide outstanding patriotic support and cooperation to their employees, who like the citizen warriors before them, have answered their nation’s call to serve.

Supportive supervisors are critical to maintaining the strength and readiness of our nation’s Guard and
Reserve units.”.

In addition to the award presentation, during the ceremony Attorney General Biden signed
ESGR’s Statement of Support. ESGR’s Statement of Support program provides a formal process for
civilian employers to publicly proclaim their support for their employees who serve in the National
Guard and Reserve and their families.

 Delaware joins settlement with DIRECTV to resolve consumer protection allegations

Wilmington – The Attorney General’s Office announced that Delaware has joined 48 other states
and the District of Columbia in a settlement with satellite television provider DIRECTV to resolve
allegations of deceptive advertising and unfair sales practices. In addition to paying $13,250,000
to the participating states, DIRECTV will also pay restitution to consumers and make changes to
its business practices. Delaware’s Consumer Protection Fund will receive $185,000.
“Attorneys General from across the country have worked together to stand up for
consumers by securing specific changes to DIRECTV’s unacceptable marketing practices and
obtaining restitution for their customers,” Attorney General Biden stated. “I encourage consumers
who were subjected to these deceptive practices to file a restitution claim through DIRECTV or by
filing a complaint with our office.”

Complaints against DIRECTV alleged that the company:
• Did not clearly disclose to consumers the price that the consumer would be charged and
the commitment term that the consumer would be required to keep DIRECTV services;
• Did not clearly disclose to consumers limitations on getting a certain price for DIRECTV;
• Enrolled consumers in additional contracts or contract terms without clearly disclosing the
terms to the consumer;
• Enrolled consumers in additional contracts when replacing defective equipment;
• Did not clearly disclose to consumers that they would automatically renew a seasonal
sports package; and
• Offered cash back to consumers when the consumer would actually receive bill credits
Consumers who have complaints against DIRECTV involving conduct after January 1,
2007 that is addressed in the settlement can file a claim for restitution directly through DIRECTV
at www.directv.com/ag or by calling 1-800-DIRECTV. They can also file a complaint with the
Attorney General’s office by visiting www.attorneygteneral.delaware.gov, calling the Attorney
General’s Consumer Hotline at 1-800-220-5424, or sending an e-mail to
consumer.protection@delaware.gov. The deadline for filing restitution claims is June 9, 2011.
The agreement requires DIRECTV to make changes to its business practices, including:
• Clearly disclose all material terms to consumers;
• Replace defective leased equipment at no cost except shipping costs and, when simply
replacing defective equipment, not require consumers to enter into an additional contract;
• Clearly disclose when a consumer is entering into a contract;
• Clearly notify consumers before they are obligated to pay for a seasonal sports package;
• Clearly disclose all limitations on the availability of local channels;
• Not misrepresent the availability of sports programming;
• Not represent that a consumer would get cash back if the consumer would actually get a
bill credit; and
• Clearly notify consumers that they will be charged a cancellation or equipment fee at least
10 days before charging the fee.

Grand Jury issues superseding indictment of Earl Bradley

Georgetown – Yesterday the Sussex County Grand Jury issued an indictment of Earl Bradley that
replaces the February 22, 2010 indictment.

This superseding indictment involves no new alleged victims or any new alleged
incidents. Instead, yesterday’s indictment reorganizes the charges contained in the February
indictment based on the investigation and identification process that has been ongoing since
December 2009. Specifically, several alleged victims who were listed under several different Jane
Doe numbers in the February indictment have since been identified as being the same victim in
multiple alleged incidents. Charges pertaining to each of these alleged victims have now been
consolidated under one Jane Doe number for each victim.

The superseding indictment also includes four additional charges of Continuous Sexual
Abuse of a Child, which pertain to multiple incidences of alleged abuse of certain victims
previously identified. Trial in this case is scheduled to begin on February 14, 2011.

The Delaware Department of Justice reminds the public that an indictment is merely an
allegation and is not evidence of guilt. Defendants are presumed innocent and are entitled to a
jury trial at which the State bears the burden of proving each charge beyond a reasonable doubt.
