Tickets now on sale for Kent Conservation District’s 18th Annual Barn Dance fundraiser on Oct. 13

DOVER – The Kent Conservation District invites everyone to a rompin’ stompin’ good time at its 18th Annual Barn Dance fundraiser to be held from 6 to 11 p.m. Friday, Oct. 13 at the Harrington Fire Company, 20 Clark Street, Harrington, DE 19952. The event features a down-home meal including beef and dumplings, fried chicken, and all the fixings, plus live and silent benefit auctions, and dancing to DJ music.

Tickets are now on sale for $20 per person or $35 per couple. Tickets for children 12 years and under are $10 each, while children under two are admitted free. Reserved tables with seating for eight are available for $150, under one name and paid by one check.

Funds raised through the Barn Dance support the Delaware Envirothon, an annual competitive, problem-solving, natural resource challenge for high school students which is sponsored by DNREC. Additionally, DNREC’s Division of Watershed Stewardship provides technical and financial assistance to Delaware’s farmers, landowners, and homeowners to protect and enhance the state’s soil and water resources, mainly through the Division’s Delaware Conservation Districts staff.

Fish & Wildlife Natural Resources Police Blotter: Sept. 4-10

Reminder for the week: Hunters should observe surroundings, take safety precautions.

DOVER  – To achieve public compliance through education and enforcement actions that help conserve Delaware’s fish and wildlife resources and ensure safe boating and public safety, Fish & Wildlife Natural Resources Police officers between Sept. 4-10 made 2,166 contacts with hunters, anglers, boaters and the general public, including 239 vessel boardings for boating safety and fishing regulation compliance checks, issuing 25 citations. Officers responded to 49 complaints regarding possible violations of laws and regulations or requests to assist the public. An increased Fish & Wildlife Natural Resources Police presence continued at the C&D Canal Conservation Area and Michael N. Castle Trail.

  • On September 9, Fish & Wildlife Natural Resources Police officers attended a hunter safety education class in Little Creek, presenting on the importance of firearms safety, game animal identification and what to expect when checked by an officer.

Incidents of note:

  • On September 8, Fish & Wildlife Natural Resources Police officers arrested Calvin R. Walters, 58, of Frankford, for three counts of possession of a deadly weapon by a person prohibited, after contacting him while hunting in the Assawoman Wildlife Area near Frankford. Walters was arraigned at Sussex County Justice of the Peace Court 3 and released on a $3,000 bond pending a future court appearance in Sussex County Superior Court.
  • On September 9, Fish & Wildlife Natural Resources Police officers arrested Trey L. Drouillard, 22, of Seaford, for one count each of criminal impersonation, possession of drug paraphernalia and littering upon a highway or adjacent property, following a traffic stop near the boat ramp in Seaford. Drouillard was issued a criminal summons for the charges with an order to appear in Sussex County Court of Common Pleas at a future date. Drouillard was transported to Sussex County Justice of the Peace Court 3 for arraignment for two outstanding capiases. Drouillard was committed to Sussex County Correctional Institute and issued a $9,000 cash bond.

Fish & Wildlife Natural Resources Police advise hunters to become familiar with state, county and local regulations before choosing their hunting spots, and share a reminder to always be observant of a hunter’s surroundings and take appropriate safety precautions.

“Hunters should always consider their surroundings and how far the ammunition they are using can travel,” said Lt. John McDerby, Fish & Wildlife Natural Resources Police, noting that it is illegal in Delaware to discharge a firearm so that a shotgun pellet, slug or bullet lands upon any occupied dwelling, house or residence, or any related barn, stable or other outbuilding.

In addition, only the owner or occupant or a person with specific permission from the owner or occupant can legally discharge a firearm within 100 yards of an occupied dwelling, house or residence, or any related barn, stable or other outbuilding. The statewide safety zone for in-season archery deer hunting is 50 yards. Within this safety zone, it is illegal for anyone other than the owner or occupant to hunt, trap, pursue, disturb or otherwise chase any wild animal or bird without advance permission of the owner or occupant.

Discharging a firearm while on or within 15 yards of a public road or right-of-way is also illegal in Delaware, unless it is an area controlled by DNREC, the Department of Agriculture or the U.S. Department of the Interior and designated as an area open to hunting or trapping. Shooting at a wild bird or wild animal in a public roadway or firing across a public roadway is also prohibited.

Upstate hunters should also note that New Castle County has its own ordinances, including a 200-yard firearm safety zone from homes, structures and camps north of I-295 and I-95 in which firearms may not be discharged, and a 100-yard firearm safety zone south of I-295 and I-95. A 50-yard safety zone for in-season archery deer hunting is in effect for all of New Castle County. For more information, please check New Castle County laws and code. 

During all firearms deer seasons, all hunters on both private and public lands, except those hunting migratory waterfowl, are required to wear hunter orange for safety reasons in the form of no less than 400 square inches of hunter orange material on the head, chest and back. Those hunting from a ground blind and completely concealed are required to place 400 square inches of hunter orange material within 10 feet outside the blind and at least 3 feet off the ground. Small game hunters and archery deer hunters are included in those required to wear hunter orange.

In addition, small game hunters should note, they are required to wear 250 square inches of hunter orange material for safety reasons. This requirement applies only on state wildlife areas; private lands are not included.

Delaware, New York and Pennsylvania Approve Resolution to Permanently Ban Fracking in the Delaware River Basin

NEWTOWN, Pa. – Governors of Delaware, New York and Pennsylvania, comprising a majority of the Delaware River Basin Commission (DRBC), announced today that they had voted in favor of a resolution put forward by the commission to issue draft regulations to permanently ban hydraulic fracturing for oil and gas in the Delaware River Basin.

The DRBC vote was three to one with one abstention in passing the resolution for promulgating regulations that would prohibit any water project in the Delaware River Basin proposed for developing oil and gas resources by high-volume hydraulic fracturing.

Delaware Governor John Carney said that the DRBC resolution is consistent with the Delaware River Basin Conservation Act, a bill introduced by Carney and passed by Congress in 2016, by helping to ensure that the water resources of the basin will be protected for present and future generations. “Fracking could diminish water resources in the Delaware River Basin, both through consumption and degraded water quality,” said Governor Carney. “We are pleased to join both New York and Pennsylvania in voting in favor of this resolution, which will protect public health, and a precious water supply. This action will guarantee that fracking for oil and gas will not threaten water resources in the Basin.”

“Protecting and preserving our water resources is paramount to ensuring the health and wellbeing of New Yorkers and of all residents living within the Delaware River Basin,” Governor Cuomo said. “With this resolution, the DRBC builds on New York’s leadership to protect the environment and public health from hydraulic fracturing, while protecting this vital water source that millions of people depend on every day. ‎I am proud to stand with my colleagues from Delaware and Pennsylvania in approving this critical resolution and we will continue to work on developing the necessary regulations to codify this commonsense resolution.”

Pennsylvania Governor Tom Wolf said he was pleased to see the DRBC take a step forward after years of study. “Today, we are acting to protect a watershed that supplies drinking water to more than 15 million people in one of the most densely populated areas of the country. I believe this resolution preserves water quality and water supply for the residents of the watershed, and will protect this precious resource for generations to come,” said Governor Wolf. “I have supported this resolution since I was a candidate for Governor of Pennsylvania, and I am proud that we have worked collaboratively to move this process forward after almost a decade of work at the DRBC.”

The Delaware River Basin, which drains from portions of New York, New Jersey, Pennsylvania, and Delaware, supplies drinking water to more than 15 million people. Governors of the four basin states and a federal representative serve as Delaware River Basin Commissioners, tasked with overseeing a unified approach to managing the river system without regard to political boundaries. The commission has oversight in the basin for water quality protection, water supply allocation, regulatory review (permitting), water conservation initiatives, watershed planning, drought management, flood loss reduction, and recreation.

The DRBC resolution comes after Congressional passage last December of the Delaware River Basin Conservation Act. As jointly authored by then-Congressman Carney and Delaware US Senators Tom Carper and Chris Coons, the Delaware River Basin Conservation Act requires federal, state and local partners to work together and preserve the basin. Congress passed the Act as part of a larger national legislative package known as the Water Infrastructure Improvements for the Nation Act.

Development of oil and gas using hydraulic fracturing in the Delaware River basin has been an issue since 2010, when the DRBC’s five commissioners voted unanimously to “postpone consideration of well pad dockets until regulations are adopted.” This action effectively placed a de facto, temporary moratorium on drilling for natural gas in several Pennsylvania counties and parts of southern New York. Since 2011, the DRBC and the signatory parties have undertaken extensive discussion and research efforts related to unconventional shale gas drilling which resulted in the resolution passed today.

In addition, to ensure protection of water resources in the Basin and beyond, Pennsylvania and New York have both developed comprehensive programs to effectively manage wastes and waste products produced as a result of high-volume hydraulic hydro-fracturing operations. These protections are an aspect of state programs to manage solid and hazardous wastes, as well as to treat wastes in accordance with the federal Clean Water Act and analogous state clean water programs.

State wildlife areas, fishing piers and boat launching facilities are closed to the public from sunset to sunrise unless a person is actively and lawfully engaged in fishing, hunting or boating in accordance with state regulations and individual wildlife area rules. Individuals not meeting these requirements and found at these sites between sunset and sunrise face fines up to $100 for trespassing after hours.

Wildlife area visitors also are reminded that it is illegal to operate motor vehicles – including motorcycles, cars, trucks and SUVs – off established roadways in state wildlife areas. Violators found to cause damage also will be cited for destruction of state property. In addition, operating a motor vehicle that is not licensed for use on established public roadways – including ATVs – is prohibited both on and off-road on state wildlife areas.

Preliminary Flood Insurance Rate Maps appeal period runs through Nov. 6 for parts of New Castle County

DOVER –DNREC’s Division of Watershed Stewardship reminds residents of New Castle County that preliminary Flood Insurance Rate Maps for portions of New Castle County released in December 2016 by the Federal Emergency Management Agency (FEMA) are currently in a 90-day regulatory appeal period ending Nov. 6.

Anyone who believes that the preliminary maps (found online at www.de.gov/floodplanning) may contain errors can submit an appeal to their community floodplain administrator. The floodplain administrator will review and consolidate all appeals before forwarding them to FEMA. Once FEMA has reviewed appeals and made a determination on their validity, the agency will issue a Letter of Final Determination to a community in question. The preliminary maps will become effective six months after the Letter of Final Determination, currently projected to be Nov. 6, 2018.

FEMA’s National Flood Insurance Program makes flood insurance available to local property owners. Mortgage lenders require borrowers whose properties are located in a designated special flood hazard area to purchase flood insurance as a condition of receiving a federally backed mortgage loan in accordance with the Federal Disaster Protection Act of 1973. FEMA’s flood risk maps are used by insurance companies to establish insurance rates and by local communities to enforce local floodplain codes.
