Secretary of State Announces Dental License Suspension

DOVER – Secretary of State Jeffrey Bullock and the state Board of Dentistry and Dental Hygiene have suspended the Delaware dental license of Dr. I-Yin Liu, in light of allegations that she has repeatedly violated standards of professional practice, has been subject to criminal arrest for her conduct, and subsequently violated the terms of her bail.

In making this determination, Secretary Bullock and the board considered the findings of an investigation by the Delaware Department of Justice, which alleges that Dr. Liu repeatedly allowed untrained, unlicensed staff in her practice to place fillings in the teeth of child patients and to administer nitrous oxide. Dr. Liu practices dentistry at All About Smiles, located in Wilmington, and Smile Place, located in Smyrna. This alleged unprofessional conduct took place in March, August and September of this year.

Dr. Liu was arrested on Sept. 29 and charged with six counts of Endangering the Welfare of a Child and one count of Health Care Fraud. She was released on bail and ordered to not allow the use of nitrous oxide in her practice by anyone other than herself. On Nov. 6, Dr. Liu allegedly directed an unlicensed person to administer nitrous oxide to a child patient, resulting in her arrest on Nov. 22 for felony non-compliance with the conditions of her bail.

Delaware Code Title 24 enables a temporary suspension pending a hearing to be issued upon the written order of the Secretary of State with the concurrence of the board chair, if the activity of the licensee presents a clear and immediate danger to public health, safety or welfare.

The suspension of Dr. Liu will remain in effect for a period of 60 days, during which time disciplinary hearings will be held or the final disposition for this individual will take place. As the result of a hearing, the Board of Dentistry and Dental Hygiene has the authority to impose disciplinary sanctions up to and including revocation of a practitioner’s license or certification.

Secretary of State Announces License Suspension

Secretary of State Jeffrey Bullock has ordered the temporary suspension of the Delaware Certified Massage Technician license of David T. Fooks of Laurel following his arrest on charges of unlawfully entering a Rehoboth residence in January.

In making his determination, Secretary Bullock considered the criminal charges by the Delaware State Police for authorizing the temporary suspension of the professional license of Mr. David T. Fooks.

The Delaware Code Titles 23 and 24 were amended on April 15, 2014, to enable a temporary suspension pending a hearing to be issued upon the written order of the Secretary of State with the concurrence of the Board chair if the activity of the licensee presents a clear and immediate danger to the public health, safety or welfare.

The suspension of Mr. Fooks will remain in effect for a period of 60 days during which time disciplinary hearings will be held or the final disposition for this individual will take place. As the result of a hearing, the Board of Massage and Bodywork has the authority to impose disciplinary sanctions up to and including revocation of a practitioner’s license or certification.

Secretary of State Announces Nursing Privilege Suspension

Secretary of State Jeffrey Bullock has ordered the temporary suspension of the privilege to practice nursing in Delaware for Whitney E. Flower of Trappe, Maryland following complaints of the licensee engaging in activities that present a clear and immediate danger to the public health, safety or welfare.

Ms. Flower is a registered nurse in the state of Maryland who practiced in the state of Delaware pursuant to the Interstate Nurse Licensure Compact and a multistate licensure privilege. As a result, she is subject to the jurisdiction of the Delaware Board of Nursing.

In making his determination, Secretary Bullock considered the written complaints filed by the Board of Nursing for temporary suspension of the privilege to practice nursing for Ms. Flower. She was arrested and charged on arrested on February 18, 2015, and charged with possession of a controlled substance with intent to distribute, possession of narcotics, and possession of paraphernalia. On June 8, 2015, Ms. Flower was observed acting in a manner consistent with being under the influence of drugs or alcohol while working at Nanticoke Hospital, subsequently testing positive for cocaine and morphine, and admitting to ingesting cocaine and Percocet.

As a result of the actions taken today, the suspension of Ms. Flower will remain in effect for a period of 60 days during which time disciplinary hearings will be held to determine the final disposition for the nurse.

Secretary of State Announces Medical License Suspension

Secretary of State Jeffrey Bullock and the Board of Medical Licensure and Discipline has issued a Temporary Order immediately suspending the medical license of Dover physician Dr. Lindsay Brathwaite.

In October 2014, the Board ordered Dr. Brathwaite’s licensed to be placed on probation for a period of 5 years after finding that he performed hundreds of biopsies and surgical procedures without any legitimate medical need, unsterile practices, and writing inappropriate prescriptions.

During the time of probation the Board further ordered that he was to not perform any biopsies or surgical procedures, was to obtain training and education, and pay a $10,000 fine. Despite the Order and the Board’s restrictions to his practice, it was found that Dr. Brathwaite continued performing biopsies on a daily basis and surgical procedures on a weekly basis.

“This behavior had previously demonstrated a real risk to the health and safety of both current and potential patients of this doctor. This blatant disregard for the restrictions placed on his practice by the Board only heightens that risk and the need to take action,” said Secretary Bullock, who can, along with the President of the Board of Medical licensure and Discipline, order the immediate, temporary suspension of a professional license.

This temporary suspension is limited to a 60-day period, during which time a disciplinary hearing will be held to determine what additional action may be necessary.

Secretary of State Jeffrey Bullock has ordered the temporary suspension of the veterinarian license of Dr. Jaine Weise of Lewes, Delaware. Dr. Weise is the owner of Vet on the Go, LLC.

In making his determination, Secretary Bullock considered the findings of the Department of Justice which found Dr. Weise had allegedly violated Delaware Code Title 24 § 3316(a)(3) in that she illegally, incompetently or negligently practiced veterinary medicine.

The Delaware Code Titles 23 and 24 were amended on April 15, 2014, to enable a temporary suspension pending a hearing to be issued upon the written order of the Secretary of State with the concurrence of the Board chair or his or her designee if the activity of the licensee presents a clear and immediate danger to the public health, safety or welfare.

As a result of the actions taken today, the suspension of Dr. Weise will remain in effect for a period of 60 days during which time disciplinary hearings will be held or the final disposition for this individual will take place. As the result of a hearing, the Board of Veterinary Medicine has the authority to impose disciplinary sanctions up to and including revocation of a practitioner’s license.
