Criminal Division | Department of Justice | Department of Justice Press Releases | Date Posted: Monday, July 22, 2013

Wilmington – Attorney General Beau Biden announced today that an undercover investigation by the Delaware Child Predator Task Force has led to the arrest of a Newark man after he traveled to a Newark motel to meet an individual who he thought was a 13-year-old girl.  During the investigation the defendant, 59 year-old Kirk Simmons, communicated with a detective from the Delaware Child Predator Task Force who was posing as the father of a 13 year-old girl.  During multiple communications with the detective, Simmons indicated that he wanted to meet to have sex with the child.  A location, date, and time to meet was set, and Simmons was arrested by the State Police Special Operation Response Team on July 18 when he arrived at the appointed location on South College Avenue in Newark.

“This latest arrest demonstrates how our Child Predator Task Force acts to take predators who would harm our children off the streets,” Attorney General Biden said.

Simmons was charged with one count of Attempted Rape 3rd Degree and was arraigned via videophone by JP Court #2. He was subsequently released after posting $60,000 secured bail.  In addition, search warrants were executed at Simmons’ residence on Stirrup Run in the Stirrup Farms development of Newark and on the vehicle that he was operating.  As a result of those searches, detectives seized multiple computers and digital storage devices and additional digital media. A forensic examination of the seized evidence is ongoing.
