Pursuant to Article XVI, Section 1 of the Delaware Constitution, the Secretary of State has published four proposed Constitutional Amendments approved by both houses of the 148th Delaware General Assembly. The proposed Constitutional Amendments were published July 2016 in local newspapers of all three counties.

The legal notices include Senate Bill 166 relating to the Transportation Trust Fund, Senate Bill 275 relating to the appointment of judges, House Bill 112 relating to the Court on the Judiciary, and House Bill 380 proposing amendments relating to continuity of governmental operations.

Secretary of State, Jeff Bullock noted, “The purpose of the notice is to ensure that Delaware citizens are aware of these proposed amendments in advance of the upcoming general election.”

Amendments must receive a two-thirds majority vote in both the Senate and House of Representatives. Two consecutive Delaware General Assemblies must approve any proposed Constitutional amendments for them to pass. These proposed amendments will become part of the Delaware Constitution if a “second leg” of the exact same amendment is approved by state legislators chosen in the upcoming general election scheduled for November 8, 2016.
