Three Men Indicted for Shootout at Wilmington Gas Station

Wilmington – Attorney General Beau Biden announced today that his office has secured indictments for three men who engaged in a December shootout at a Getty gas station in Wilmington.

 

“Fortunately, no one was struck by gunfire in this confrontation, but that doesn’t lessen the shattered sense of security that residents feel in communities where these senseless shootings occur,” Attorney General Biden said.  “We must hold those who commit crimes with guns accountable for their violent and destructive behavior.”

 

The incident took place at approximately 9:00 p.m. on December 23, 2012 as 20 year-old Corey Rollins came into contact with 24 year-old Jamar Rodgers and 24 year-old Kenyattia Graham at a Getty gas station at 30th and Market Streets in Wilmington.  A shootout among the gas pumps ensued as Rogers and Graham, who were traveling together, traded gunfire with Rollins.  Multiple shots were fired before Rollins, Rogers, and Graham fled.  A vehicle occupied at the time by an adult and three children was struck by the gunfire and an additional bystander was nearly struck.  More than a dozen shell casings were later found by police at the scene.

 

Suspect Corey Rollins, age 20, was arrested by Wilmington police a short time later while driving a truck with a deflated tire that was struck in the shooting.  Police recovered from the vehicle a loaded Smith and Wesson semi-automatic handgun and 73 grams of crack cocaine.

 

On February 4 the Attorney General’s office secured a 17-count indictment charging Rollins, 24 year-old Jamar Rodgers, and 24 year-old Kenyattia Graham with weapons, Reckless Endangering, and other offenses for the crime.  Charges and bail status are as follows:

 

Corey Rollins remains in custody on $510,000 cash bail.  The indictment charges Rollins with 5 counts of Reckless Endangering, 7 counts of Possession of a Firearm During the Commission of a Felony, and one count each of Possession of a Firearm by a Person Prohibited, Possession with the Intent to Distribute a Controlled Substance, Aggravated Possession of a Controlled Substance, and Possession of Marijuana.

 

Jamar Rogers has remained in custody on $240,000 cash bail since his December 27 arrest.  The indictment charges Rogers with 5 counts of Reckless Endangering, 5 counts of Possession of a Firearm During the Commission of a Felony, and one count of Possession of a Firearm by a Person Prohibited.

 

Kenyattia Graham has remained in custody on $170,000 cash bail since his arrest February 6.  The indictment charges Graham with 5 counts of Reckless Endangering and 5 counts of Possession of a Firearm During the Commission of a Felony.

 

The Delaware Department of Justice reminds the public that an indictment is merely an allegation and is not evidence of guilt.  Defendants are presumed innocent and are entitled to a jury trial at which the state bears the burden of proving each charge beyond a reasonable doubt.
