Biden’s office secures indictment charging Newark father with death of infant daughter

Wilmington – Attorney General Beau Biden announced today that his office has secured an indictment charging a Newark man with the death of his infant daughter.

 

“The death of this young child shocks the conscience of us all,” Biden said.  “Children are especially vulnerable to violent and abusive behavior by those who are responsible for their care and we’re using the full force of the law to hold this individual accountable for his actions.”

 

On the evening of August 17, 2012, paramedics responded to a call from James Love who reported that a child was not breathing at his residence in the Carlton Court Apartments in Newark.  The victim, Love’s 3 month-old daughter, was in the sole care of Love at the time of the 911 call.  The child was unresponsive and was taken initially to Christiana Hospital, and then to Nemours/Alfred I. duPont Hospital for Children.  The child died on August 19, 2012.

 

An autopsy conducted by the Medical Examiner determined that the death was caused by multiple blunt force injuries and ruled it a homicide.  New Castle County Police conducted a thorough criminal investigation into the death, along with Biden’s Child Victims Unit.  As a result of that investigation on September 3 the Attorney General’s Office secured an indictment by the New Castle County Grand Jury charging James Love, age 40, with Murder by Abuse or Neglect for the death of his daughter.

 

At the time of this week’s indictment Love was already serving a two year prison sentence for a February, 2013 conviction for unlawful sexual contact.  Yesterday, Love was arraigned from the Howard R. Young Correctional Institution on the murder charge and was ordered held without bail.

 

Biden commended the lead investigator on the case, New Castle County Police Detective James Leonard, III, for the thorough investigation that led to this week’s indictment and arrest.

 

The Delaware Department of Justice reminds the public that an indictment is merely an allegation and is not evidence of guilt. Defendants are presumed innocent and are entitled to a jury trial at which the State bears the burden of proving each charge beyond a reasonable doubt.
