State Auditor’s Office Issues First Audit of Dual Employment of Government Officials Since 2017

Dover, DE – Delaware Auditor of Accounts Lydia E. York issued a milestone Dual Employment Performance Audit Report for the fiscal years 2020-2022 today. The audit, which evaluated employers on their compliance with State law on the compensation of elected and appointed officials dually employed by multiple State entities, is the first to be issued since 2017. It is also the most comprehensive such report issued to date. The report is the first since 2011 to include a population of dually employed officials, and the first to include data from the University of Delaware.

“The issuance of the Dual Employment Audit underscores this office’s commitment to following a process that results in increased transparency and accountability for Delaware,” said Auditor York. “Past Dual Employment audits have been met with scope impairment and incomplete results. This time we decided to change our approach and are now able to present the most thorough and complete Dual Employment Audit report to date.”

“For the first time in 13 years, the Auditor’s report provides the Public Integrity Commission with concrete data upon which the administration and implementation of the Dual Compensation law can actually be evaluated,” said Delaware Public Integrity Commission Counsel Deborah J. Moreau. “The report provides the Commission with a roadmap from which it may focus on the populations and organizations most in need of guidance.”

The Dual Employment Audit tested 22 dually employed officials and includes findings of noncompliance for employers including the City of Dover, Delaware General Assembly, Delaware State University, Delaware Technical Community College, Eastside Charter School, and the University of Delaware, as well as a repeat finding for a lack of a central database of dually employed officials. The University of Delaware contends that it is not subject to the Dual Employment law, has not complied with past Dual Employment Audits, and did not provide full records to the State Auditor’s office.

“This audit is simply about ensuring that employers paying staff with taxpayer dollars have policies in place preventing officials from being paid for two jobs at one time,” said Auditor York. “The Dual Employment law has been in Delaware code since 1986. It is past time that those policies are created and strictly followed. I fully intend to uphold this office’s mandate and continue auditing Dual Employment compliance.”

Delaware Auditor of Accounts Lydia E. York is a public servant with decades of experience in accounting, finance, and the legal profession. In 2022, she became the first African American woman elected to executive office in Delaware history.
