Governor Matt Meyer Celebrates Signing of House Bill 170 Updating Delaware’s Microbrewery Law

WILMINGTON — Yesterday, Governor Matt Meyer ceremonially signed House Bill 170 at Brew Works North. The bill was signed into law in June, updating Delaware’s microbrewery law and giving businesses more flexibility in how they operate. Wilmington Brew Works is one business that was able to open a second brew pub, Brew Works North, as a result of the new law.
“This legislation further supports small businesses and local entrepreneurs who are creating jobs and building community across our state,” said Governor MattMeyer. “Delaware has a proud craft brewing tradition, and HB 170 gives these businesses the flexibility they need to keep growing and innovating here at home.”
Sponsored by Representative Debra Heffernan and Senator Dan Cruce, House Bill 170 amends Title 4 of the Delaware Code relating to microbreweries. Former law only allowed Delaware craft brewers to operate one microbrewery and two brew pubs. The new law allows brewers to instead operate two microbreweries and one brew pub if they choose.
This change enables microbreweries to decide the business model that best fits their growth, while continuing to support Delaware’s small businesses, tourism, and local economy.
“Delaware’s craft and microbreweries are a source of pride for our state and a real driver of local economic growth,” said Rep. Debra Heffernan. “HB 170 gives these small businesses more flexibility to grow so that they can keep doing what they do best: making great beer and bringing people together.”
“Small businesses are the backbone of our communities, and Delaware’s entrepreneurs are driving job creation and economic growth across the state,” said Sen. Dan Cruce. “Our local microbreweries and brewpubs are great examples of how small businesses fuel innovation, provide good jobs, and strengthen our economy while also building spaces where neighbors connect. By giving them more flexibility, we’re helping them expand and thrive. I want to thank Gov. Meyer for signing this legislation and supporting the entrepreneurs who keep Delaware’s economy strong.”
