Delaware Office of the Marijuana Commissioner Clarifies Policy on County-Based License Assignments
Dover, DE — The Delaware Office of the Marijuana Commissioner (OMC) is issuing this statement to clarify recent confusion regarding county-based license assignments in the state’s adult-use marijuana program. Contrary to recent reports, county-based assignments have not been removed.
Licensees will continue to be assigned to specific counties as part of Delaware’s regulatory framework. However, the OMC is maintaining limited flexibility to consider reassignments under certain circumstances. This approach ensures the program can adapt to real-world challenges while maintaining compliance with state law and regulatory safeguards.
To be considered for reassignment, applicants must provide:
“Maintaining county-based assignments is central to our program’s design, but we recognize the importance of ensuring licensees have a viable path to establishing operations,” said the Commissioner of the OMC. “This policy allows for flexibility where justified, while keeping the integrity of the assignment framework in place.”
The OMC remains committed to transparency and ensuring applicants have clear, accurate information about licensing requirements and processes. Additional guidance and FAQs will be made available at omc.delaware.gov.
